New requirements tie state tax exemption eligibility to commitments on energy costs, grid reliability, workforce development and community investment.
BATON ROUGE, La. — Gov. Jeff Landry announced the completion of Louisiana’s Ratepayer and Community Protection Framework, establishing requirements for prospective data center companies seeking state tax incentives while formalizing protections for residents and host communities.
The framework implements the Louisiana Ratepayer and Community Protection Initiative, which Landry established through an executive order in June. Completed four months later, it sets expectations for companies applying for Louisiana’s Data Center Sales and Use Tax Exemption.
The initiative is designed to support digital infrastructure investment while requiring participating companies to address potential impacts on electricity customers, public infrastructure, natural resources and local communities.
Data Center Incentives Linked to Long-Term Louisiana Commitments
Under the framework, applicants must demonstrate meaningful commitments across eight areas. Requirements address protecting existing ratepayers from project-related cost shifts, strengthening grid reliability, supporting Louisiana’s workforce and communities, contributing to local tax bases, protecting natural resources, expanding the state’s innovation economy, and maintaining transparency and accountability.
Companies will be able to tailor their commitments to the needs and priorities of the communities where they plan to locate.
The Data Center Sales and Use Tax Exemption will also transition to an invitation-only program for prospective companies prepared to make significant, long-term commitments to Louisiana.
“Under President Trump’s leadership, America is entering a new era of digital infrastructure, and Louisiana is leading the way. This framework ensures we remain at the forefront of the age of digital factories and super intelligence while protecting our citizens and communities,” said Gov. Jeff Landry. “We have set the standard for how states can pursue these opportunities responsibly and put their people first.”
Applicants Must Document Measurable Project Commitments
Before receiving the exemption, applicants must submit a detailed attestation explaining how they will meet the framework’s requirements.
Louisiana Economic Development will coordinate the evaluation process with state agencies and local partners. Reviews will incorporate input from the:
- Louisiana Department of Conservation and Energy.
- Louisiana Public Service Commission.
- Louisiana Department of Environmental Quality.
- Project’s proposed energy provider.
The coordinated review is intended to evaluate each project’s commitments and establish accountability from the beginning of the incentive process.
“For projects participating in this program, the framework turns Louisiana’s priorities into measurable commitments from the start,” said LED Secretary Susan B. Bourgeois. “It gives us a clear way to evaluate how each project will contribute to Louisiana over time and to hold companies accountable for the commitments they make. That accountability helps ensure major investments create lasting value for our state.”
Louisiana Adopts “Digital Factories” Terminology
Louisiana will refer to these facilities as “digital factories” going forward, reflecting their expanding role in advanced computing and the production of digital goods and services.
The Data Center Sales and Use Tax Exemption will retain its existing name to remain consistent with state statute.
State officials identified Louisiana’s energy resources, industrial infrastructure, workforce and experience delivering large-scale projects as advantages in attracting advanced computing investment. The new framework establishes how participating projects must align that investment with protections and benefits for Louisiana communities.
